Avrupa Birliği ve Türk hukukunda meslek hastalıklarının kayıt altına alınmasına ilişkin yasal düzenlemeler

Abstract

Ülkeler düzeyinde meslek hastalıklarının tanılanması ve kayıt altı-na alınması konusunda yetersizlikler bulunmaktadır. Çalışanın yakalan-dığı bir hastalığın yaptığı iş ya da meslek nedeniyle ortaya çıkıp çıkma-dığının tespitinde yaşanan sorunlar, meslek hastalıkları ile ilgili istatistik verilerini de dolayısıyla etkilemektedir. İş kazaları ve meslek hastalıkları ile ilgili istatistiklerin doğruluğu, bu yöndeki sorunlara çözüm üretmek ve yeni stratejiler geliştirmek açısından önemlidir. Avrupa Birliği hukukunda, meslek hastalıklarıyla ilgili verilerin kayıt altına alınmasını belirli standartlara indirgeyen çeşitli hükümler bulunmaktadır. Özellikle tavsiye kararları ile Birlik düzeyinde özel bir standardın oluşturulması hedeflenmiş, meslek hastalıkları listesi oluştu-rulmuş ve meslek hastalıklarının tanılanması ile ilgili olarak ortak bir bilinç oluşturulmuştur. Bu doğrultuda meslek hastalıklarına ait istatistik-sel rakamların daha etkin ve başarılı bir şekilde kayıt altına alınabilmesi-nin önü açılmıştır.

There are inadequacies concerning identification and recording of the occupational diseases at the country level. The problems in deter-mining whether the disease caught by an employer is because of the work or occupation he/she performs affect the statistical data concern-ing the occupational diseases. True statistics concerning occupational accidents and occupational diseases are of great importance in terms of finding a solution to these kinds of problems and developing new strategies. In European Union law, there are some regulations that standard-ises the recording of the data concerning the occupational diseases. Es-pecially with the advisory jurisdictions, forming a particular standard at Union level has been aimed, the list of occupational diseases has been compiled and a collective consciousness concerning the defining of the occupational diseases has been constituted. Accordingly, these pawed way for the recording of the statistical numbers related to occupational diseases in a more effective and successful way.
